REGULATORY AND LEGAL PROVISION OF FINANCIAL SECURITY IN UKRAINE

Abstract

The article presents provisions on the regulatory and legal provision of financial security under martial law. Attention is drawn to the fact that the current state of legislative regulation of the prevention of offenses in the financial sector is characterized by the imperfection and imbalance of regulatory and legal acts at all levels, the absence of an officially recognized Concept for the development of a regulatory and legal framework for the organization and functioning of the system for combating such offenses, the disunity of subjects, the duplication of their individual functions, and the insufficient level of legal support for the interaction and coordination of law enforcement and other state bodies. The author justifies the need to amend the current legislation in order to form a unified, flexible and balanced system for ensuring the financial security of the state. At the present stage, it is relevant to determine conceptual approaches to reviewing legislative acts in this area. It is proposed to place special emphasis on the development of a basic law that would establish the basic principles and specifics of the functioning of the financial security system. Implementing a comprehensive approach to improving the legislation of Ukraine on ensuring the financial security of the state, it is necessary to proceed from the fact that the relevant basic Law should form the basis for the formation of this segment. Its main tasks are: implementing a single coordinated mechanism for the functioning of the financial security system, in particular, ensuring effective coordination of the actions of entities that have legal status in the specified area, as well as implementing a systematic approach to planning and ensuring the implementation of measures to ensure financial security; creating qualitatively new opportunities for the effective application of all methods and means by which the financial security of the state is ensured, etc.
