SOME ASPECTS OF THE CRIMINOLOGICAL CHARACTERISTICS OF A WAR CRIMINAL AND HIS VICTIM

The relevance of the article is substantiated by the need to study the criminological characteristics of a war criminal and his/her victim in order to improve the prevention of criminal offences in this area. The purpose of the article is to make a comprehensive study of the criminological characteristics of a war criminal and his/her victim in the area of war crimes prevention. In accordance with international legal documents, the study reveals the concept of war crimes. The author provides a criminological characterization of the personality of a war criminal and his/her victim in order to further improve the effectiveness of combating war crimes and strengthen the authority of the bodies involved in this fight. The author outlines the components of the criminological characteristics of a war criminal and his/her victim in the prevention of war crimes. It is noted that the criminological characteristic of a war criminal can be considered by the socio-psychological features of behavioral perception of reality. This does not exclude his/her biophysiological, sociodemographic characteristics, roles and statuses, and criminal law features. It is determined that war crimes are most characterized by mercenary-violent motivation, where mercenaries is manifested not only in the illegal acquisition of material goods, but also in the sense of power over people. It is emphasized that negative personality traits of war criminals are formed in extremely negative microenvironmental conditions, in conditions of reduced social control. The aggressive behavior of war criminals is predominant. The article provides a typology of war crimes, including the one based on the nature of interaction between the situation in which the crime was committed and the individual. The author provides the inherent features of war criminals and the most typical groups of war crimes motivation, as well as the victimological aspect of the personality characteristics of a war criminal and his/her victim. In accordance with the aims and objectives set, the article uses general and special methods and techniques of scientific cognition, including: methods of analysis and synthesis; methods of classification and grouping, which allowed to study a wide range of scientific discussions on this issue.
