THE AUTHORIZED PROBATION AUTHORITY AS A ENTITY FOR PREVENTING AND COMBATING DOMESTIC VIOLENCE

Abstract

The article analyzes the powers of such a subject of prevention and counteraction to domestic violence as an authorized body for probation. During the period of reform and improvement of the criminal justice system of Ukraine, to which the probation service belongs, the latter requires the introduction of new methods and approaches. Taking into account European approaches, the number of categories of probation subjects has increased. This especially applies to work with their various categories, which are united by the specifics of the offense committed, since such convicts have special criminogenic factors. Understanding the features and potential of the probation agency in this area will contribute to improving the mechanisms of work with persons who have committed domestic violence or criminal offenses with signs of domestic violence at the legislative level, they are defined as offenders. Work with offenders by probation staff is carried out during the period of supervisory probation, which applies to the largest part of persons registered with authorized probation agencies. The tools and mechanisms that the personnel of the authorized body for probation use in working with persons convicted of domestic violence and criminal offenses related to domestic violence, other offenders, have been studied.It has been determined that the activities of the authorized body for probation with the above-mentioned subjects involve the use of such a tool as a probation program. The program is intended for work with adult and minor subjects of probation - women and men: released from serving a sentence with probation, who are obliged by the court to carry out measures provided for by the probation program; in whom, according to the results of the assessment of the risks of committing a repeated criminal offense, risk factors have been identified that determine the use of the probation program "Overcoming Domestic Violence".
