ПРАВОВЕ ЗАБЕЗПЕЧЕННЯ АДВОКАТСЬКОЇ ТАЄМНИЦІ ПРИ ВИКОРИСТАННІ ХМАРНИХ СЕРВІСІВ І СИСТЕМ ШТУЧНОГО ІНТЕЛЕКТУ

Статтю присвячено правовому режиму адвокатської таємниці в контексті використання адвокатами хмарних сервісів та штучного інтелекту іноземних провайдерів. Виявлено конкуренцію обов’язку нерозголошення адвокатської таємниці й режиму захисту персональних даних під час транскордонної передачі інформації. Запропоновано вирішення шляхом застосування принципу lex specialis derogat generali з пріоритетом законодавства про адвокатуру. Проаналізовано практику Європейського суду з прав людини, рекомендації CCBE та ABA, сформульовано пропозиції щодо вдосконалення законодавства.
