Abstract

The article provides a comparative legal study of the legislation of Ukraine and EU countries, which provides for criminal liability for the deliberate introduction of dangerous products into circulation. Under the influence of European integration processes, new standards are being implemented in Ukraine, which are formed as a result of these processes, in particular, all manufacturers are required to put only safe products on the market. Deliberate introduction of dangerous products into circulation in Ukraine is punishable by a fine and deprivation of the right to hold certain positions or engage in certain activities. EU legislation contains direct requirements for member states to carry out market surveillance. In EU countries, market surveillance is an important tool for ensuring the implementation of directives. Products are brought into compliance with product safety requirements by means of measures to check product compliance with current directives. The principle of priority of the lower link in decision-making is applied. That is why EU countries can independently determine the administrative structures that will be used to fulfill their obligations in this area. Germany, Spain, Bulgaria, Croatia, Latvia, Lithuania and Poland transfer criminal liability for the preparation and introduction into circulation of unsafe food products and speeches. In addition, in Spain, France, the Netherlands, Croatia, Bulgaria and Lithuania, criminal activity stagnates to distributors and sellers, as if they gave unsafe lives and healthy lives. Positive for Ukraine is the proof of Poland, as it transfers the criminal liability for the mind and the carelessness of the speeches, or the introduction into the use of unsafe speeches, helping to calm down the other products of the everyday speech. Qualifying signs of a criminal offense are the death of a person, or a serious injury to a healthy person.
