SOME FEATURES OF THE CREATION AND FUNCTIONING OF MILITARY AND CIVIL ADMINISTRATIONS UNDER THE CONDITIONS OF MARTIAL STATE IN UKRAINE

Abstract

The article deals with questions about the features of creation, some issues of functioning and determining the powers of military-civilian administrations in the conditions of martial law in Ukraine. Emphasis is placed on the advantages of civil-military administrations over local councils and their executive committees. Specific reasons are given that indicate the need for such a replacement. Sufficient attention has been paid to the goals of creating military-civil administrations, which consist in the need to create conditions for ensuring the vital activity of the respective territorial communities, resolving issues of local importance by establishing a special procedure, exercising certain powers, local governments (village, settlement, city councils, their executive bodies, regional, district councils) on the territory their activities, in cases where the relevant local self-government bodies do not exercise such powers or have withdrawn from their implementation. That is why, in those cases when local self-government bodies do not do their job, the local authorities are replaced by a military-civilian administration. In some places such administrations have been working for 6 years. At the time of the adoption of the Law of Ukraine “On Civil-Military Administrations” dated February 3, 2015 No. 141-VIII, the military-civilian administration in Ukraine was defined as a temporary state body as part of the Anti- Terrorist Center under the Security Service of Ukraine or as part of the Joint Operational Headquarters of the Armed Forces of Ukraine, operating in the area of rebuffing the armed aggression of the Russian Federation on the territory of the Donetsk and Lugansk regions and was intended to ensure the implementation of the Constitution and laws of Ukraine, ensure security and normalize the life of the population, law and order, counter sabotage and terrorist acts, and prevent a humanitarian catastrophe. The difference between them is that the civil-military administrations of settlements are legal entities of public law. In contrast, district and regional state administrations simply temporarily acquire the status of civil-military administrations and do not require the registration of a separate legal entity. From a practical point of view, military administrations are extremely important for the inhabitants of the respective territories, since they are authorized to make decisions on which people’s lives depend: evacuation, imposition of curfews, and much more. When it comes to villages, towns and cities, the military administrations of such settlements can be formed in one or several settlements. Such an administration may be formed if the village, settlement, city councils and/or their executive bodies do not carry out the tasks assigned to them by the Constitution and laws of Ukraine powers, incl. due to: 1) actual self-dissolution; 2) self-withdrawal from the exercise of their powers; 3) actual non-execution of powers; 4) termination of powers by law. Thus, from 05:30 on February 24, 2022, a special legal regime has been introduced in Ukraine, which provides for “providing the relevant state authorities, military command, military administrations and local governments with the powers necessary to prevent a threat, repel armed aggression and ensure national security, eliminate the threat of danger state independence of Ukraine, its territorial integrity, as well as temporary, caused by a threat, restriction of the constitutional rights and freedoms of a person and a citizen, the rights and legitimate interests of legal entities, indicating the duration of these restrictions.
