THE PLACE OF A PERSON’S REPRESENTATIVE (DEFENDER) IN DISCIPLINARY PROCEEDINGS IN POLICE BODIES: DOMESTIC AND FOREIGN EXPERIENCE

Abstract

In this article, the authors considered the peculiarities of representation in disciplinary proceedings in the bodies of the National Police of Ukraine. Attention was drawn to the specifics of its normative and legal regulation, which is carried out by a fairly wide range of acts that regulate disciplinary proceedings within the framework of general disciplinary responsibility and special disciplinary responsibility. It was noted that disciplinary proceedings in the bodies of the National Police of Ukraine are carried out against three categories of persons: police officers, civil servants and police officers who perform functions not related to the performance of their duties. This determines the peculiarities of the application of normative legal acts in a specific case. Most often, the need for representation in disciplinary proceedings carried out in the bodies and units of the National Police of Ukraine arises from persons whose actions are being conducted, or interested persons, who may be applicants, victims and third parties. Peculiarities of representation in disciplinary proceedings in the police bodies of foreign countries are studied using the example of the police of England and Wales, Poland, the USA, and the Federal Republic of Germany. Attention was drawn to the possibilities of improving disciplinary proceedings in the bodies of the National Police of Ukraine, in particular by integrating certain aspects of the experience of representation in the disciplinary proceedings of the police of foreign countries.
