INDIVIDUAL DETERMINANTS AFFECTING MINORS IN ILLEGAL OWNERSHIP OF VEHICLES IN UKRAINE

Abstract

The article examines certain determinants affecting the illegal possession of vehicles by minors in Ukraine. It is indicated that the determinants of illegal possession of vehicles by minors must be differentiated as follows: 1) socio-educational determinants – due to the lack of public morality due to the lack of necessary knowledge, skills and skills of social dialogue; 2) organizational and managerial – determinants caused by the absence of a well-established state management mechanism (political and economic instability); 3) legal – determinants caused by gaps in the legislative and law-making apparatus of the state. It is noted that the spread of alcoholism, drug addiction, and gambling among teenagers often pushes them to commit criminal offenses, which can be explained by the desire to earn money for alcohol and drugs, to assert themselves in front of their peers, or causes uncontrolled behavior that is a consequence of intoxication. Untimely response by law enforcement officials to the illegal possession of vehicles by minors, inadequate protection of parking spaces, lack of the necessary number of video surveillance cameras, etc. – all these are almost the most important factors that contribute to the commission of the investigated criminal offense by minors. It is concluded that today the illegal possession of vehicles by minors is a fairly widespread act, which is due to a number of determinants, the main ones of which are identified social-educational and normative-legal gaps, as well as the nihilism of law enforcement agencies. Modern Ukraine needs actual theoretical and applied studies capable of reducing the qualitative and quantitative indicator of the specified type of illegal activity by eliminating the relevant deterministic complexes.
