THE PHENOMENON OF JURIDIZED MORALITY IN THE UKRAINIAN LEGAL TRADITION

The article highlights the phenomenon of juridized morality in the Ukrainian legal tradition. The core problem of legal reform is the implementation of the constitutional principle of the rule of law, which means the humanization of the legal sphere, filling it with the anthropocentric dimension, which it currently lacks. The principle of the rule of law is potentially very humanistic, but its implementation requires a rethinking of a number of related legal aspects, in particular, the problem of the relationship between morality and law, as well as the role and significance of non-state natural law regulators of social relations. In line with the Ukrainian legal tradition, since the times of princely Ukraine, the phenomenon of juridized morality has been developing, which was destroyed by the colonial dependence of Ukraine, the totalitarian system in the past and which needs to be revived and applied in the process of implementing legal reforms today. Juridized morality is a moral content that is legally formalized, which appears in the form of a legal custom, a legal contract, a legal (fair, based on universal principles of law, does not violate human rights, etc.) law, a legal court ruling, etc. Ukrainians preserved and, as far as possible, unofficially, theoretically and practically developed juridized morality, since it, having its origins in their living existence, corresponded to their interests, the value and semantic dimension of their worldview. Ukrainian thinkers, within the framework of juridized morality, constantly raise the problem of human and civil rights and freedoms, community and people, defend universal values, and actualize the issue of human relations. Juridized morality is interpreted as the value-semantic basis of state law, in this regard, Ukrainian legal thought is much more developed, really European in comparison with the state-centric legalist Russian. In modern Ukraine, the revival of juridized morality and its use in legal reform is necessary, since the consequence of this will be the enrichment of the humanistic dimension of social relations, which we lack so much now.
