CRIMINAL LIABILITY FOR ILLEGAL ACTIONS WITH SPECIAL TECHNICAL MEANS OF COVERT OBTAINING INFORMATION

The article examines the specifics of criminal liability for illegal actions with special technical means of secretly obtaining information. It is emphasized that the actions described in Article 359 of the Criminal Code of Ukraine “Illegal acquisition, sale or use of special technical means of obtaining information” encroach on various objects of criminal law protection. Thus, the illegal purchase or sale of special technical means of covertly obtaining information creates a threat of harm or harm to economic activity, since such actions are carried out on the basis of a license obtained. Taking this into account, it is proposed to exclude special technical means of secretly obtaining information from the list of contraband items, as a criminal offense provided for in Article 201 of the Criminal Code of Ukraine. In addition, add Chapter VII of the Special Part of the Criminal Code of Ukraine “Criminal Offenses in the Sphere of Economic Activity”, Article 203-3 “Illegal development, manufacture, supply of special technical means of secretly obtaining information”. Illegal use of special technical means of secretly obtaining information encroaches on such an object as the rights and freedoms of a person and a citizen. View of the above, it is proposed to exclude Article 359 of the Criminal Code of Ukraine. Instead, provide for criminal liability for the illegal use of special technical means of covertly obtaining information in Article 182-1 of Chapter V of the Special Part of the Criminal Code of Ukraine “Criminal offenses against electoral, labor and other personal rights and freedoms of a person and a citizen”. It is summarized that the proposed changes will contribute to the systematization of criminal legislation taking into account the object of criminal law protection and may serve as a basis for further research into the problems of illegal actions with special technical means of secretly obtaining information.
