THE CONCEPT AND LEGAL NATURE OF THE LEGITIMACY AND LEGALITY OF STATE POWER

The article is devoted to the study of the concept of legitimacy and legality of state power. It is emphasized that legitimacy and legality are the main aspects that ensure stability and order in society. It is determined that the legitimacy of power guarantees its moral and social recognition among citizens and different social groups. It provides trust in the authorities, creating conditions for the stable functioning of democratic institutions and preservation of democracy. If the authorities are legitimate, then the decisions it make will be perceived as fair and justified by the majority of the population, which contributes to social harmony and political consensus. It is generalized that legality concerns the legal basis of state power, ensuring that its actions comply with legislation and international legal norms. Legality guarantees that the authorities operate within the legal limits, which is important for ensuring the rights and freedoms of citizens and protection against abuse of power. The distinction between the concepts of legitimacy and legality is important for understanding the mechanisms that ensure the stability and efficiency of the state. It is emphasized that both aspects (legitimacy and legality) mutually complement each other, creating the preconditions for effective and stable state activities. Only with the legitimacy and legality of state power can it ensure the full functioning of the institutions of democracy and the legal mechanism of protection of the rights and freedoms of citizens. For the stability of state power, it is necessary to combine legitimacy and legality. Without legality, the authorities can be in doubt in terms of its validity, and without legitimacy, even legitimate power may be ineffective due to lack of support from the population.
