LAW IN THE CONDITIONS OF DIGITAL TRANSFORMATION OF MODERN SOCIETY

The scientific publication is devoted to the study of the transformation of law under the influence of digital technologies.The author considers law as a «conductor» of information technologies, which causes profound changes in the law itself, legal institutions, legal practice and legal relations. The article emphasizes that information technologies create new conditions and factors for the emergence, change and termination of legal relations, which are reflected in new phenomena of legal reality.The author focuses on trends related to the digitalization of law. It is noted that law in the context of the digital transformation of modern society is filled with new content.The scientific article attempts to understand the impact of digitalization processes on the state and legal sphere of society, law as a regulator of social relations, forecasting these phenomena of legal reality in the future, and setting fundamental and applied tasks of legal science in terms of doctrinal mastery of the laws of development and functioning of law in the digital reality. The issues of the essence of digital law are revealed. Doctrinal approaches to the interpretation of the legal nature of digital law (IT law) are analyzed. It is stated that the differences in approaches are explained more by the scientific preferences or the sphere of interests of their authors than by deep doctrinal developments.However, it cannot be denied that the consequence of digitalization is the emergence of cyclical legal bodies that do not belong to any branch of law, but at the same time permeate entire branches of law with their norms.The author concludes that the use of digital technologies contributes to the formation of a new digital environment of legal regulation and at the same time actualizes the problem of adapting law to the capabilities of modern information technologies.
