ADMINISTRATIVE AND LEGAL STATUS OF THE STATE MIGRATION SERVICE OF UKRAINE

Abstract

The article is devoted to the analysis of the administrative and legal status of the State Migration Service of Ukraine. The State Migration Service of Ukraine is a central executive body, the activities of which are directed and coordinated by the Cabinet of Ministers of Ukraine through the Minister of Internal Affairs and which implements state policy in the areas of migration (immigration and emigration), including counteraction to illegal migration, citizenship, registration of individuals, refugees and other categories of migrants defined by law. The concept and features of the State Migration Service of Ukraine as a central executive body implementing state migration policy are disclosed, its service nature is determined. The norms of the Regulation on the State Migration Service of Ukraine are analyzed, amendments to it are proposed in terms of defining the tasks of the State Migration Service of Ukraine. The approaches of scientists to the concept and structure of the administrative and legal status of the State Migration Service of Ukraine are considered. It is determined that the elements of the administrative and legal status of the State Migration Service of Ukraine are tasks and functions, competence (subjects of responsibility and authority), responsibility. The authority of the State Migration Service of Ukraine is mainly related to the provision of administrative services in the areas of migration (immigration and emigration), including counteraction to illegal migration, citizenship, registration of individuals, refugees and other categories of migrants defined by law. A feature of the administrative and legal status of the State Migration Service of Ukraine is that it is a central executive body that performs service functions, that is, provides administrative services within its competence.
