GROUNDS FOR SUSPENSION OF PRE-TRIAL INVESTIGATION IN CRIMINAL PROCEEDINGS CONCERNING MINORS

The author analyzed the path to the formation, as well as the prospects for the implementation of strategic goals declared in the National Strategy for the Protection of Children’s Rights in the Sphere of Justice for the Period Until 2028, as well as the measures provided for in the operational plan for its implementation. It noted which pilot projects have been implemented and are being implemented in Ukraine and are aimed at implementing international standards of child-friendly justice in practical activities. Particular attention was paid to the status of the implementation of the pilot project - the Restorative Justice Program with the participation of minors who are suspects or accused of committing a criminal offense, the progress of its implementation and the problem of the lack of proper regulatory and legal regulation of the results of the application of the specified Program. The importance of restorative procedures for minors in criminal proceedings, the need to supplement the grounds for stopping the pre-trial investigation in criminal proceedings against minors, such as the fulfillment of the terms of the mediation agreement, is substantiated. Attention is drawn to the institution of removing a minor from criminal proceedings provided for by the Strategy, namely the possibility of the prosecutor closing criminal proceedings against minors who have committed criminal misdemeanors or non-serious crimes, as well as against persons who have not reached the age of criminal responsibility for committing the specified category of socially dangerous acts. Attention is focused on the need to suspend pre-trial investigation in criminal proceedings on offenses of this category in connection with the beginning of the procedure for removing a minor from criminal proceedings, as well as on the mandatory introduction of rehabilitation programs for minors, monitoring the progress of their implementation, and an individual approach to their selection.
