Abstract

The scientific article examines some general scientific and special legal methods that can be used in the study of the system of state registration of rights to real estate. The author pays attention on the lack of previous scientific research on the methodological bases of the research of the state registration system of rights to real estate that negatively affects the formation of relevant theoretical provisions. That is why, according to the framework of this scientific research, the author carried out a comprehensive analysis of general scientific and special legal research methods of the state registration system on rights to real estate. It was determined that the research’s methods of the state registration system on rights to real estate should be considered as a system of tools and methods of revealing the content, purpose, and patterns of formation and development of the regulatory and legal bases of the state registration system of rights to real estate. General scientific methods of research of the state registration system of rights to real estate are systematized: historical, linguistic, system-functional, method of analysis and synthesis, methods of induction and deduction, synergetic, dialectical, method of forecasting and modeling. Special legal methods of the research of state registration system of rights to real estate are: formal and legal method, method of evolutionary epistemology, and axiomatic. The author founded that in the structure of the research methodology of the state registration system of rights to real estate general scientific methods are important. They are a base of research, provided an opportunity to reveal the content, purpose, pattern of the formation and development of the state registration system of rights to real estate, to characterize it as an element of the legal system of Ukraine. It has been demonstrated that special legal methods of scientific research make it possible to analyze the regulatory and legal foundations of the state registration system of rights to real estate and also consider the organizational and methodological features of the directions and principles of the state registration system of rights to real estate.
