Abstract

The article substantiates reasonable accommodation as a procedural guarantee of the barrier-free nature of civil proceedings for war veterans. The armed aggression of the russian federation against Ukraine has significantly increased the number of veterans with permanent or temporary functional limitations –physical, sensory and psychological –whose effective participation in civil proceedings is impeded by objective barriers. Empirical data cited in the literature indicate that approximately 77 % of wounded veterans face difficulties in obtaining their status, compared with approximately 53 % among those not wounded, which confirms that the decisive factor is functional condition rather than formal category. Drawing on Article 2 and Article 13 of the Convention on the Rights of Persons with Disabilities, the author distinguishes procedural accommodation from reasonable accommodation: the wording of Article 2 contains the reservation concerning a disproportionate or undue burden, whereas Article 13 contains no such reservation, since access to justice as a precondition for the exercise of all other rights cannot be made dependent on considerations of proportionality of costs. The study analyses the developments of 2025–2026: Resolution of the Cabinet of Ministers of Ukraine No. 1673 of 17 December 2025, which placed the burden of proving a disproportionate burden on the entity responsible for implementation; Decision of the Council of Judges of Ukraine No. 13 of 22 May 2026, which approved methodological recommendations on barrier-free access for veterans in the administration of justice; and Resolution of the Cabinet of Ministers of Ukraine No. 902 of 1 July 2026, which empowered the Ministry of Veterans Affairs in the field of access to justice. It is demonstrated that all these instruments remain outside procedural law: the Council of Judges expressly stated that the recommendations do not establish a special procedural status of a veteran and do not alter the rules of judicial procedure, since acts of a recommendatory nature belong to soft law and do not create procedural obligations of the court. Accordingly, the need for accommodation has been recognised but not operationalised. The author substantiates a functional rather than a status-based criterion of accommodation and formulates five directions for improving the Civil Procedure Code of Ukraine, including enshrining the principle of accessibility of proceedings, the court’s duty to provide procedural accommodation, a mechanism for requesting accommodation with an appropriate allocation of the burden of proof, transforming remote participation into an instrument of barrier-free justice, ensuring communication accessibility and raising judges’ awareness. Prospects for further research are connected with drafting specific procedural provisions and extending the proposed model to administrative proceedings
