INDIVIDUAL LABOR DISPUTES: MAIN TRENDS AND CURRENT CHALLENGES OF EFFECTIVE RESOLUTION IN THE PERIOD OF MARTIAL STATE

Abstract

The relevance of the chosen topic is due to significant changes in the field of labor relations that arose directly in connection with the full-scale invasion of the Russian Federation on the territory of Ukraine on February 24, 2022 and the subsequent implementation of the legal regime of martial law throughout the territory of our country. It can be argued that in recent years, the Ukrainian labor market has faced many challenges, in particular: mass movements of the population, both within the country and the migration of labor potential abroad, downsizing, as well as the growth of social tension not only between employees and employers, but also in society in general, which in turn has led to an increase in the number of individual labor disputes, which as of today, more than ever, require a timely, fast and fair solution. In addition, scientific interest in understanding the main trends and practice of resolving individual labor disputes during martial law is extremely important for the formation of a stable legal environment now, as well as for accelerating the recovery of our state in the post-war period. Therefore, the choice of this topic is not only timely and theoretically significant, but also practically oriented. The article examines the main features of individual labor disputes that distinguish them from other legal conflicts and analyzes the reasons for their occurrence. The necessity of normative consolidation of the concept of “individual labor dispute” in the Code of Labor Laws of Ukraine is substantiated. The impact of individual labor disputes on the stability of labor relations in general and the peculiarities of the procedure for consideration of individual labor disputes under martial law are outlined. Particular attention in the article is focused on the need to update the mechanisms for the settlement of individual labor disputes through mediation in order to adapt them to modern challenges. New approaches to ensuring the balance of interests of the parties to labor relations in emergency situations have been determined, which can become the basis for further reforming the labor legislation of Ukraine
