TRANSFORMATION OF THE INSTITUTION OF LEGAL GUARANTEES IN UKRAINE UNDER ADAPTATION TO THE ACQUIS COMMUNAUTAIRE: A THEORETICAL AND LEGAL ANALYSIS

The article is devoted to investigating the transformation of the institution of legal guarantees and the category of «firmness» («guaranteedness») in the legislation of Ukraine under the influence of adaptation to the acquis communautaire. The aim is to define the theoretical and legal essence of legal guarantees in specific areas of public administration under the conditions of European integration and martial law. The authors' contribution consists of conducting a systematic monitoring of regulatory legal acts and identifying a specific defect in legislative technique within the Law of Ukraine «On the Electricity Market», where a blanket norm refers to non-existent «rules» for capacity allocation instead of the effective «Procedure» of the National Commission for State Regulation of Energy and Public Utilities. It is demonstrated that this conflict is caused by a literal translation of the term «rules» from EU Regulations. Based on doctrinal analysis, the concepts of «rules» (regulatory character) and «procedure» (instrumental character) are delineated. The evolution of guaranteeing from declarative forms to effective security instruments is explored. Positive preventive guarantees in the field of healthcare are examined through the case of Regulation (EC) No 178/2002 and the Law of Ukraine on the basic principles and requirements for food safety and quality. Furthermore, the transformation of a procedural guarantee in the area of environmental safety (environmental impact assessment) is analyzed in accordance with Directive 2011/92/EU and domestic legislation, which, since March 2022, adaptively exempts activities aimed at national defense and post-war recovery from the assessment process. Finally, the protective role of restrictions in media legislation is studied pursuant to Directive 2010/13/EU and the Law of Ukraine «On Media», where the prohibition of «hate speech» and affiliations with the aggressor state serves as a guarantee of social stability during the war.
