TACTICAL OPERATIONS IN SEX CRIMES INVESTIGATION METHODS

The allocation of tactical operations in the investigation methods of certain types of criminal offenses is an important methodological approach to structuring pre-trial investigation. This approach is very relevant for the formation of methods for investigating sexual crimes, taking into account the change in the paradigm of their criminal legal interpretation in 2018. This was due to the implementation of the provisions of the Council of Europe Convention on preventing and combating violence against women and domestic violence. Currently, a number of theoretical provisions and practical recommendations for the investigation of crimes against sexual freedom and sexual integrity require rethinking. The article analyzes the features of pre-trial investigation of sexual crimes. Attention is drawn to the fact that the formation of updated investigation methods should include the use of the forensic concept of tactical operations. In this regard, investigative situations are distinguished that are associated with the presence or absence of a social connection of acquaintance between the victim and the sexual abuser. In accordance with them, tactical tasks and means of solving them are distinguished – tactical operations. Tactical operations are a complex of investigative (detective) and organizational actions that reflect the specifics of the tasks of investigating a particular type of crime. This allows you to give the content of the methods of investigation of sexual crimes greater systematicity. It is concluded that the allocation of tactical operations in the structure of methods of investigation of sexual crimes is an important methodological approach. It allows to define tactical tasks of investigation which cannot be solved within the limits of separate procedural actions. Such approach makes it possible to establish regular connections between carrying out separate procedural actions, which gives signs of systematization in formation of theoretical provisions and practical recommendations in methods of investigation.
