INTERNATIONAL COMPENSATION MECHANISM OF COMPENSATION FOR DAMAGES CAUSED BY THE AGGRESSION OF THE RUSSIAN FEDERATION

Abstract

The scientific article deals with the creation of an international compensation mechanism of compensation for damage and losses caused by the aggression of the russian federation on the territory of Ukraine. The article emphasizes that the international community is determined to oblige the russian federation to compensate for the damage and losses caused by the aggression. During the Council of Europe Summit in Reykjavík, the Statute of the Register of Damages Caused by the Russian Federation's Aggression Against Ukraine was approved. The Conference of Ministers of Justice of the Council of Europe adopted the “Riga Principles” that regulate the main principles of functioning of the Register of Damages. The damage register was created for the purpose of documenting the evidence related to claims for compensation for damages caused by the internationally illegal actions of the russian federation on the territory of Ukraine since February 24, 2022. The registry does not have the jurisdictional function of making decisions regarding claims. Members of the register can be member states, observer states of the Council of Europe, and the European Union in the status of Participant or Associate member. The register consists of the Conference of Participants, the Board of the Register, the Executive Director, and the Secretariat. Resolution of the Cabinet of Ministers of Ukraine “On approval of the Procedure for determining damage and losses caused to Ukraine as a result of the armed aggression of the Russian Federation” as of 20.03.2022 No. 326 defined the subjects of the submission, divided them into categories, subcategories by types of damage and losses: natural person (category A ); the state of Ukraine (category B); legal entities (enterprises, institutions, organizations) (category C). The second step in creating an international compensation mechanism is to secure funding. The main source of coverage is the sanctioned sovereign assets of the russian federation. Today, the international community is working on a legal mechanism for the confiscation of sovereign assets of the russian federation in order to transfer them to the Compensation Mechanism for payments to victims of aggression and to people injured by the aggression of the russian federation.
