ALLEGATIONS OF GENOCIDE CASE: LEGAL ANALYSIS OF UKRAINE’S APPLICATION TO INTERNATIONAL COURT OF JUSTICE

The article is devoted to the legal analysis of Ukraine’s application of 26 February 2022 to the International Court of Justice to institute proceedings against the Russian Federation in a dispute concerning the interpretation, application, and fulfilment of the 1948 Convention on the Prevention and Punishment of the Crime of Genocide. The legal argumentation of Ukraine regarding the assertion that there is a dispute between it and Russia regarding the interpretation, application, and fulfilment of the Convention on Genocide based on the application of a systemic approach to Articles I, III and IX of this Convention has been considered. The falsity of Ukraine’s accusations of acts of genocide in the Donetsk and Luhansk regions has been emphasized. It has been proven that Russia used a false accusation of genocide as a basis to justify its aggression against Ukraine. First, Russia recognized the so-called “Donetsk People’s Republic” and “Luhansk People’s Republic”. Then, it launched a so-called “special military operation” against Ukraine to punish Ukraine for acts of genocide that did not actually occur and for preventing “alleged” genocide in the future. The article emphasizes that the dispute between Ukraine and Russia regarding the interpretation, application, and fulfilment of the Genocide Convention in the context of the allegations of genocide is the first case of its kind in the history of the International Court of Justice.
