HISTORY OF THE DEVELOPMENT OF FORENSIC PSYCHIATRIC EXAMINATION

Abstract

Judicial examination is an integral element of criminal, economic, administrative and civil proceedings. The legislative basis for forensic examination is the Law of Ukraine “On Forensic Examination”, which define the legal, organizational and financial principles of judicial expert activity to ensure the justice of Ukraine with independent, qualified and objective expertise. Forensic psychological examination is an important element of judicial practice, as it helps to clarify the psychological aspects of legal issues that arise in the course of the judicial process. It can also help establish the causes and consequences of certain behavioral reactions, which may be important for the court's decision. The article contains information on the history of the development of forensic psychiatric examination. The stages of emergence, formation and development of forensic psychiatric examination are defined and analyzed. The article examines the emergence of forensic psychiatric examination, as an independent direction of forensic examinations, and its implementation in judicial practice. Next, in the article, the formation of forensic psychiatric and complex forensic psychological and psychiatric expertise is considered, namely: organizational – legal, theoretical and methodological issues. The development of criteria for forensic psychiatric expert assessment of legally significant abilities of participants in the criminal process, namely: victims, witnesses and accused persons, is also considered. In addition, the proposed article contains an analysis of the development of forensic psychiatric examination, taking into account the legislation of Ukraine, the emergence of forensic psychiatric examination, the introduction of the specified types of examinations into the Civil and Civil Procedure Codes.
