JUDICIARY PRECEDENT AS A SOURCE OF LAW IN UKRAINE’S CONTEMPORARY LEGAL SYSTEM: THEORETICAL AND LEGAL ASPECTS

The article presents the research into judiciary precedent as a source of law in Ukraine’s contemporary legal system. Special attention is paid to the theoretical and legal aspects of the correlation between positive and natural law. It is stated that one of the modern tendencies of the Ukraine’s legal system development is the review of the vision of law through the awareness of the dialectic correlation between positive and natural law. It is stressed that a crucial aspect of the solution of topical problems, which rose for the legal community, is the use of potential and the development of particular mechanisms to implement positive and natural law. Consequently, the author substantiates the idea of the scholars who assert the importance of natural law as the so-called moral evaluation and the original sources of the regulations of positive law where the latter stands out as the source of natural law consolidation and specification. It has also been proved that an important aspect of the definition of judiciary precedent is its correlation with judiciary practice. It is stressed that it is the judge who plays a leading role in the process of legal life and practice improvement. The article states that each EU member state applies its own approach to the definition of judiciary practice and judiciary precedent, however in all the countries judiciary precedent has a persuasive authority. At the same time the factor of the formation of EU precedent law creates favorable conditions for its adoption and implementation as a source of the native legal system.
