ANTI-CORRUPTION POLICY IN THE RAILWAY INDUSTRY: LEGAL ASPECT, TODAY’S REALITIES AND REFORM PERSPECTIVES

The article is devoted to the anti-corruption policy, which is carried out at the enterprises of the railway industry, taking into account the legal aspect, the realities of today and reform perspectives. The essential content of the conceptual category “anti-corruption policy” is determined and the author’s position is given regarding its interpretation, taking into account the peculiarities of the functioning of railway enterprises. The advantages of the updated content of the conceptual category “anti-corruption policy of railway enterprises” are substantiated and the expediency of its adaptation is revealed. The normative-legislative regulators that ensure the adaptation of the directions of the anti-corruption policy of the enterprises, outlining the peculiarities of the functioning of the enterprises of the railway industry, are considered. Attention was drawn to the content of the Anti-corruption program of the Joint-Stock Company “Ukrainian Railway”, the main directions of its adaptation were highlighted and the expediency of making changes related to the strengthening of the fight against corruption was substantiated. The main purpose, task and content of the roadmap of the activities of the Unified strengthened specialized unit for Compliance and prevention of corruption at the enterprises of the Joint-Stock Company “Ukrainian Railway” are outlined. The directions of promising initiatives and ideas regarding the strengthening of anti-corruption policy measures developed by forum participants under the slogan “Railway Agents of Change” as part of the “Ukrainian Railway Future” project were revealed. The author’s position is provided regarding the expansion of anti-corruption policy measures at railway enterprises in the future. The issue of combating corruption challenges at railway transport enterprises is gaining particular relevance in view of the lack of own financial resources for development in the conditions of military aggression by the Russian Federation. The very understanding of the essential content of the anti-corruption policy of railway transport enterprises requires a more objective interpretation, which will contribute to the adoption of more balanced decisions in the management of anti-corruption measures. It is expedient for the top management of railway transport enterprises to adapt the conceptual category “anti-corruption policy of railway enterprises” in the anti-corruption management system. Among the areas of improvement of the management cycle on anti-corruption issues is to provide for the adjustment of the existing Anticorruption program taking into account the legislative initiatives set out in the Law of Ukraine “On the principles of state anti-corruption policy for 2021–2025”; the introduction of mandatory monitoring control, not only in terms of the timeliness of adaptation of planned anti-corruption measures, but also monitoring actions from the point of view of the meaningfulness of measures and realistic implementation; implementation of work to avoid duplication of functional duties of persons acting as developers and executors of the anti-corruption program, which will contribute to maintaining the time lag and speed up the process of adaptation of the intended measures.
