THE ROLE OF PUBLIC -PRIVATE PARTNERSHIP IN OPTIMIZATION OF HEALTHCARE SPHERE (ON THE EXAMPLE OF PERSONALIZED MEDICINE): RISKS AND PROSPECTS

The article deals with the legal issues of public-private partnership in the sphere of healthcare. The authors focus on different forms and models of public-private partnership. The aim of the study is to analyze the features and risks of each one. Prospects for optimization of the healthcare field are analyzed. The article examines the value of publicprivate partnership for the further development of healthcare system, taking into account the active infrastructural stage of medical reform. In addition, the models of public-private partnership under active consideration for health sector in Ukraine are investigated in detail. Nowadays the reformation process is complicated due to the current war. Thus, the aim of the article is to evaluate if and how public-private partnership can be used to strengthen the health system in Ukraine. It is concluded that it is necessary to develop clear and understandable models for the improvement of clinical and diagnostic services using a public-private partnership, taking into account potential risks, while remaining flexible when choosing the legal form of such a partnership. It is proved that the movement towards personalized medicine could be reasonable to start with such “light” models of public-private partnership based on certain assets, for example, diagnostic laboratories. The issue of personalized medicine is too extensive to be solved within the framework of individual organizations or through the implementation of one project within the framework of a public-private partnership. The complex legal relations on the border of various fields in personalized medicine are described. It is proved that personalized medicine is an innovative direction, therefore it is advisable to take into account the peculiarities of public-private partnership in the innovative sphere as well.
