METHODS OF THE CRIME OF ILLEGAL HANDLING OF WEAPONS, AMMUNITION OR EXPLOSIVES

The negative dynamics of the increase in the number of crimes provided for in art. 263, 263-1 of the Criminal Code of Ukraine indicates the need to study the forensic characteristics of illegal handling of weapons, ammunition or explosives, in particular, typical methods of committing the specified crimes. The article is devoted to the study of the method of committing the crime as an element of the forensic characteristics of the investigation methodology. Forensic scientists define the method of committing a crime as a set of actions of a criminal in preparing, committing, and concealing an illegal act. The method of crime, as a criminological concept, includes information not only about the direct execution of illegal actions, but also about the person of the criminal, and is also expressed in changes in the surrounding environment and reflected in the traces left by the person at the scene of the crime. The article defines that the method of committing a crime is a set of actions of a criminal regarding the preparation, execution and concealment of illegal actions carried out with the aim of committing a crime and realizing a criminal intent. Scientific developments on the main ways of committing crimes based on the fact of illegal handling of weapons, ammunition or explosives were studied. The methods of preparing the specified crimes, as well as the peculiarities of their concealment, are outlined. Such methods of illegal handling of weapons, ammunition or explosives are described as illegal carrying, illegal storage, illegal acquisition, illegal transfer, illegal sale, illegal manufacturing, illegal processing or repair or falsification, illegal removal or alteration of its marking. Based on the analysis of investigative and judicial practice, typical ways of committing illegal handling of weapons, ammunition or explosives have been identified, which include: illegal carrying, illegal storage, illegal acquisition, illegal sale, illegal manufacturing, illegal processing or repair, or falsification.
